If you have a kid in school in Texas, you might want to double-check their bags. HB 114 goes into effect for the 2023-2024 school year.

The new bill calls for immediate alternative school for any child caught with a vape, aka e-cigarettes. Some schools are genuinely worried that they won't have room for all the students heading to alternative school.

They are basing those fears on the sheer number of kids caught with vapes on campus. The new law takes effect on September 1, 2023, near the start of the school year.

Heavy Consequences For Texas Students Caught Selling Vapes

If just possessing a vape on campus lands you in an alternative school, getting caught with 5 or more could lead to even more drastic actions and could be labeled as distribution. HB 114 also lumps e-cigarettes into the same bill with narcotics, marijuana, alcohol, and major crimes.

The bill even has a contingency plan for the disciplinary alternative education program hitting capacity. If this happens then the campus behavior coordinator will decide if they qualify for the lesser in-school suspension.
